Terms of Service

The Tea Party Army® has created this site TPA.US (We put “wee” in Tweet™) site (hereinafter variously referred to as “this service” or “tpa.us”) to promote pro-American, anti-socialist, educational efforts using short, self-branded URLs and grants a limited, permissive license to others to use it pursuant to the terms and conditions set forth below.

Using TPA.US for spamming, illegal, anti-constitutional, or anti-American purposes is forbidden and any such use will result in the shortened URL being disabled and you may be reported to all ISPs involved and to the proper governmental agencies.

This service is provided without warranty of any kind.  There is no promise, warrant or assurance that any shortened URL obtained using this service will function for any specific period of time beyond which this site is able to be maintained for tpa.us, its server system.  Any change in legal restrictions (federal, state or local) may also effect the ability to provide continuously operating shortened links.  Thus, there is no promise, warrant or assurance that any shortened URL will operate for any period of time.  While this service will use reasonable efforts to continue the interoperability of shortened links, such continuation cannot be promised, warranted or assured.

If there is any claim made against our service, either directly or indirectly, it must be decided by binding arbitration utilizing the Federal Arbitration Act in Henderson, Nevada.  Each party to the arbitration shall pay their own fees and costs including attorney fees and charges.  Each party shall appoint one arbitrator of its choosing and the arbitrators so chosen shall appoint an equal number of additional arbitrators so as to make the complete number of arbitrators an odd number where neither party, or parties, enjoys an advantage in the number of arbitrators.  For example, if there is a party  on one side with 3 members and 1 on the other, then three such additional arbitrators shall be added at the sole cost and expense of the party with 3 members.  No arbitrator shall be added without the explicit agreement of all parties.  All hearing shall be heard using electronic media and communications to the extent possible.  Digital signatures may be used at the option of the submitting party.  The laws of the United States shall be used to determine the outcome.  No party shall be given any preference(s) for any reason whatsoever based upon their race, religion, political persuasion, national origin or assumed racial characteristics such as, but not limited to, a dual ethnicity such as black American or white American or hispanic American, etc.

Any award of damages ordered by any arbitration proceedings shall be limited to the amount paid by the damaged party(ies) to the other party.  No additional damages of any type, description or quality may be awarded.

The award of the arbitrators shall be the full, final and complete resolution of any dispute and such award is enforceable in a court of competent jurisdiction resident in the State of Nevada as though it were a judgment on the merits thereof after a trial.

Any person using this site to shorten any URL is doing so through a permissive license granted to it by this service.

Any person using the permissive license granted hereby must agree to be bound by the terms and conditions set forth in these Terms of Service, including the provisions for arbitrating all disputes, and is deemed to have so agreed by usage to shorten any link, clicking on any shortened link created here or in any other way exploited shortened links produced here such as by using on social media or sending through email; and, if there is no such agreement at any time, any such non-agreeing person is denied any license to use the system of URL shortening and such non-agreeing person is banned from any such use, and any use previously permitted is automatically revoked.
